Terms and Conditions for supply of goods by Jewellers Loupe Ltd.
1. Introduction
These terms and conditions (together with our privacy notice, which can be found on our website www.jewellersloupe.co.uk (“Website”), (“Terms and Conditions”) confirm the basis on which we supply any of our products (“Products”) shown or described on our Website to you.
Please read these Terms and Conditions carefully before placing your order. By ordering any Products you agree to be bound by our Terms and Conditions. Should you not wish to be bound by these terms and conditions then you should not proceed with any order of Products from our Website.
2. About us
2.1. www.jewellersloupe.co.uk is a website owned and operated by The Jeweller’s Loupe Limited (“We”, “Us”), a Company registered in England and Wales under Company Number 10814545. Our registered office is at 51 Harrogate Road, Leeds, LS7 3PD.
2.2. Our Website is provided free of charge and we have the right to amend, suspend or delete the Website or any part of it, at any time, and without notice.
2.3. Your use of our Website is subject to our Website Terms of Use which can be viewed here. We would recommend that you review these terms carefully and ensure you understand them before using this Website.
3. About you
By placing an order through our Website you agree and warrant that you are:
3.1. legally capable of entering into binding contracts;
3.2. at least 18 years of age; and
3.3. you are purchasing as a consumer. If you are purchasing Products in the course of your business then separate terms and conditions will apply. Please contact us at hi@jewellersloupe.co.uk for further information.
4. Website Content and Amendments
4.1 We make all reasonable efforts to ensure that the images of our Products, the prices displayed, and any descriptions of our Products, or any services we may offer, is accurate.
4.2 All images are for illustrative purposes only and any measurements or dimensions displayed are approximate. Products and packaging received may vary slightly from the images shown.
4.3 In terms of the colour of Products, we accept no liability for colours not matching the colour displayed on your viewing monitor or screen as this is dependent on the quality and abilities of your monitor or screen.
4.4 In the event minor changes are made to our Products between the date your Order is made and the Delivery of your Product, for example where a change is required to comply with a regulatory or legal requirement, or in order to address any technical, safety or security issue, we will provide you with the updated Product so long as the change does not affect the main characteristics of the Product or our use and enjoyment of the Product. In the event the required changes may affect your use of the Product we will contact you and advise you accordingly.
4.5 We reserve the right to make changes to the Website and to these Terms and Conditions at any time and without any notice or warning. Such changes may include, but are not limited to:
4.5.1 additions, amendments, modifications or removal, to any or all of these Terms and Conditions;
4.5.2 additions, amendments, modifications or removal of any promotions, offers or discounts;
4.5.3 additions, amendments, modifications or removal of Products, product descriptions, product information or any other Website content;
4.5.4 temporary or permanent withdrawal of the Website.

5. Placing an Order
5.1. After placing your order (“Order”) you will receive an email from us acknowledging that we have received your Order and confirming the details of your Order.
5.2. Our email acknowledgment is not our acceptance of your Order. Your Order will only be accepted once we are satisfied that:
a. we are able to provide you with the Product;
b. the details of the Product are correct;
c. payment has been approved and processed.
5.3. We will confirm our acceptance of your Order by sending an email confirming that we are willing and able to provide you with the Product to your specific requirements (“Confirmation Email”). The contract (“Contract”) between us will be formed when we send the Confirmation Email.
5.4. Once the Confirmation Email has been sent we shall begin work to create your Product. During the creation process we shall send you a further email attaching a photograph showing the Product being created.
5.5. Once the Product creation process has concluded we shall send you a further email to confirm a delivery date (Dispatch Email) and we shall arrange to deliver the Product to you.
5.6. Should there be any conflict between these Terms and Conditions and any term of the Order then the Order will take priority.
5.7. In the event you have paid for a Product and we are unable to supply or deliver the Product to you we shall notify you by email and provide you with a full refund of the purchase price paid along with any delivery costs paid.
6. Your Rights to Cancel
6.1. If you are a consumer then you have a legal right to cancel your Contract within 14 days starting from the day after you received the Product.
6.2. If during the 14-day period you decide to cancel the Contract you must notify us of your decision and you will be entitled to a full refund of the price paid for the Product.
6.3. To cancel your Contract you must inform us in writing by email or by post to hi@jewellersloupe.co.uk or 3 Stainbeck Corner, Leeds, LS7 3PG. When contacting us please include your name and your order number.
6.4. When cancelling your Contract you must also return the Product to us immediately in the same condition in which you received it and at your own cost and risk unless the Product is faulty or not as described. The Product is your responsibility once it is delivered to you until the time it is returned to us.
6.5. The cancellation of your Contract will take effect from the date your email or letter notifying us of your cancellation is sent.
6.6. Your right to cancel does not apply to any Product that is:
6.6.1. bespoke, or made to your specific requirements;
6.6.2. Sealed for hygiene reasons and you have unsealed it;
6.6.3. Mixed with other items after you receive it and is unable to be separated.
6.7. Once we receive your notice of cancellation we shall provide you with a refund subject to the terms set out below.
7. Refunds and Returns
7.1. If you cancel your Contract then upon receipt of the returned Product we shall provide you with a refund of the price you paid for the Product. Products should be returned to us in their original packaging and should be undamaged and unworn. We reserve the right to make a deduction to your refund amount where the Product has been damaged or mishandled by you.
7.2. If you cancel your Contract then we shall also refund any standard delivery costs you have paid. We shall not refund any higher cost delivery options such as special delivery or next day delivery.
7.3. Where you discover that your Product is faulty or not as described then you should contact us by email at hi@jewellersloupe.co.uk with details of the fault. Upon receipt of your email we will contact you to arrange for a refund, repair or replacement. In some cases, it may be necessary for us to inspect the Product before any offer of a refund, a repair or a replacement is made. Where an inspection is necessary, we shall arrange for the Product to be returned and we shall provide you with a full refund of the purchase price you have paid for the Product along with any delivery costs you have paid.
7.4. We shall not provide a refund in respect of any Product which is returned due to a fault where upon inspection a genuine fault is not found or a fault is found but we determine that such fault has been caused by you or where it is clear that the Product has been worn.
7.5. We shall not provide a refund for any reason once the 14 day cancellation period has passed, save for where the product is faulty or not as described.
7.6. Where you have purchased a ring and the size is incorrect, we will resize the ring at a cost of £50. The ring must be returned to us in our original packaging and you shall be responsible for the costs and for the risk of returning the Product to us for resizing. If you are unsure of the correct ring size a size-guide and up to 3 ring models in sizes of you choice are available upon request.
7.7. All refunds will be processed with 14 working days from the date we receive the Product back from you unless we advise otherwise in writing.
7.8. Refunds will be made using the payment method and details used by you to purchase the Product.
7.9. It shall be your responsibility to return the Product to us and you will be responsible for all costs connected with returning the Product to us.
8. Delivery
8.1. Your Order will be delivered within 30 days from the date of the Dispatch Email unless we advise you otherwise.
8.2. Delivery of your Order will be completed when:
a. the Product has been delivered to the delivery address provided by you;
b. the Product has been delivered directly to you; or
c. a delivery service organised by you collects the Product from us.
You will be responsible for the Product once the Delivery has been completed as set out above.
8.3. Delivery costs are additional to the price of any Product.
8.4. We do not deliver to addresses outside of the UK. Please contact us at hi@jewellersloupe.co.uk should you have any queries in relation to a delivery outside of the UK.
8.5. Where we are unable to deliver your Product as set out above, we will contact you by email to arrange alternative delivery arrangements. In the event we are unable to contact you we will treat the Contract as cancelled, we will recover the Product, and we will provide you with a refund of the purchase price you paid for the Product. No refund will be made in respect of any delivery costs and we reserve the right to charge you for any reasonable costs we incur in recovering the Product.
8.6. Where we fail to deliver the Product, as set out above, within 30 days from the date of the Dispatch Email, or within such other timescale as we have agreed, then you shall be entitled to treat the Contract as cancelled provided that one of the following apply:
8.6.1. We have refused to deliver the Product;
8.6.2. Delivery of the Product within the agreed time period was essential; or
8.6.3. You informed us at the time you Ordered the Product that delivery within that time period was essential.
9. Price and Payment
9.1. The Price of Products will be as shown on our Website, except where there is an obvious error.
9.2. We reserve the right to make changes to our prices at any time. Any changes will not affect the price of Products where a dispatch email has been sent prior to a price change being made.
9.3. Our prices include VAT but are exclusive of any delivery costs. In the event the VAT rate changes between the date of your Order and the date we take payment from you the amount of VAT which is payable will be automatically adjusted.
9.4. In the event it comes to our attention that a Product displayed on our Website is incorrectly priced, where the correct price is lower than the price shown on our Website, we shall charge the lower amount. Where the Product’s correct price is higher than the price shown on the Website we shall contact you to ask whether you wish to proceed with the purchase at the correct, higher price, or we shall reject your Order and notify you that your Order has been rejected.
9.5. Where a pricing error exists and that error is obvious, unmistakable and could have been reasonably recognised by you then we shall have no liability or obligation to provide the Product to you at the lower, incorrect price.
9.6. Payment for your Product should be paid by credit or debit card in advance. Your card will be charged once the order is confirmed.
9.7. We accept payment via Stripe.
9.8. Ownership of the Product will pass to you once we have received payment in full of all sums due. Payment in full includes any applicable delivery charges.
10. Our Promise to you
10.1. We want you to be entirely happy with your Product. To ensure quality we check all products by hand and stamp each product with an assay mark before delivery.
10.2. We guarantee that each product is free from material defects for a period of 6 months from the date of delivery.
10.3. In the event there is a defect with your Product, we will repair it free of charge if you return it to us within 6 months from the date of delivery, provided you have not had it altered, repaired or adjusted by another jeweller or company. Any work that is not carried out by us will invalidate your guarantee and render it void. To protect the guarantee, all work must be carried out by us.
10.4. In the event we cannot repair the defect with your Product, we will offer you the option of a full refund or a replacement Product.
10.5. Our guarantee does not apply:
10.5.1. to everyday wear and tear and use of the Product;
10.5.2. where the Product has been altered, adjusted or repaired without our knowledge or consent;
10.5.3. to damage caused to the Product by you;
10.5.4. to bespoke Products or Products made to a specific requirement requested by you.
10.6. Our guarantee is in addition to your legal rights as a consumer.
11. Our Liability
11.1. Our liability to you for any losses that you suffer as a result of us breaching these Terms and Conditions or our negligence is limited to the purchase price of the Product and any reasonably foreseeable losses.
11.2. Our liability does not exclude or limit:
11.2.1. death or personal injury caused by our negligence;
11.2.2. fraud or fraudulent misrepresentation;
11.2.3. defective products under the Consumer Protection Act 1987;
11.2.4. breach of the implied terms of the Consumer Rights Act 2015 (namely satisfactory quality, fitness for purpose, description, installation); and
11.2.5. breach of the implied terms of the Sale of Goods Act 1979 (title and quiet possession).
12. Events outside of our control
12.1. We shall not be responsible for any failure to perform, or a delay in the performance of any of our obligations under these Terms and Conditions which is due to an event happening which is outside of our control (“Event”).
12.2. An Event beyond our control includes any event or act beyond our reasonable control, including, but not limited to, strikes, lock outs or other industrial action, civil commotion, riots, invasion, terrorist attack or suspected terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of shipping, railways, aircraft or other means of public or private transport, failure of the use of public or private telecommunications networks.
12.3. Should an Event arise which affects our performance then:
12.3.1. we shall contact you as soon as possible;
12.3.2. the time for performance under our contract and our obligations under these Terms and Conditions will be suspended for the duration that the Event continues;
12.3.3. if your delivery date is affected by an Event then we shall contact you with an updated delivery date once the Event is over;
12.3.4. Where an Event continues for more than 14 days you have the right to cancel your Contract in accordance with the Cancellation provisions set out above. Should you wish to cancel your Contract then please follow the process set out above.
12.3.5. We reserve the right to cancel your contract where an Event continues for longer than eight weeks.

13.2. Where we need to contact you, we shall use the contact information you provided when you made your Order.
13.3. Notice will be deemed received and properly served 48 hours after an email is sent, or 3 working days after the date of posting of any letter.
14. Complaints
14.1. We handle complaints in accordance with our complaints handling policy.
14.2. In the event you wish to complain or provide us with feedback, you can contact us by post or email using the contact information above or by telephone.
15. General
15.1. We may assign our rights and obligations under these Terms and Conditions to any other person. In the event such an assignment arises then we shall inform you in writing by post or email.
15.2. You cannot transfer your rights and obligations under these Terms and Conditions to any other person without our written approval.
15.3. The contract shall be between you and us. No third party shall have any right to enforce any terms.
15.4. In the event any provision of these Terms and Conditions is deemed to be invalid, or unenforceable for any reason then that provision shall be struck out and the remaining provisions shall remain valid and enforceable.
15.5. Our failure to insist that you perform any of your obligations under these Terms and Conditions or to enforce our rights against you, or delay in doing so, does not mean that our rights against you have been waived and does not mean that you need not comply with those obligations. Should we choose to waive your default then we will confirm this in writing. Our decision to waive your default does not apply to any future defaults that may arise.
15.6. These Terms and Conditions and our Privacy Notice represent the entire agreement between us and supersede all other negotiations, previous agreements, correspondence, promises, assurances, warranties, representations, understandings or discussions between us whether written or oral, relating to its subject matter.
15.7. These Terms and Conditions and the arrangement agreed between us shall be governed by the exclusive jurisdiction of the Courts of England and Wales and the laws from time to time in force.
16. Guarantee
16.1. We believe that all of our jewellery is of the highest quality and we will guarantee our products for 2 years from the date of purchase against manufacturing defects.
16.2. All products are hallmarked according to UK legislation, which guarantees that the materials have been checked by a UK government-approved agency.
16.3. For the price of £50 (including insured and signed for return) we are happy to clean, polish and check any diamonds and/or gemstones are still tightly set. Please contact us to take up this service.
